Andrew H. Eres
Andrew Eres is a member of the firm concentrating his practice in the areas of real estate based and complex commercial litigation. Andrew has represented corporations, partnerships, financial institutions, developers, investors, creditors and individuals in breach of contract, breach of fiduciary duty, shareholder derivative, trade secret, restrictive covenants, foreclosures, statutory construction, debt collection, lender liability, fraud, negligence, title insurance claims, trademark/copyright infringement and other claims throughout the United States. Andrew is an aggressive litigator who is committed to his client’s business needs. In addition to his busy practice, Andrew also serves on Stahl Cowen's Management Committee.In the areas of real estate litigation, Andrew’s practice includes, but is not limited to, mortgage foreclosures, including creditor bankruptcy work, representation of condominium associations and real estate developers, construction defect litigation, mechanics’ lien and landlord-tenant disputes, and actions for specific performance of contracts. Andrew has extensive experience in the field of mortgage foreclosures, having foreclosed on hundreds of commercial, residential, and industrial properties. For many years, Andrew represented one of the nation’s largest residential lenders. As part of his foreclosure practice, Andrew has represented secured creditors in bankruptcy proceedings and has worked with court-appointed receivers. Andrew is also engaged in all types of adversary proceedings, such as preference claims, fraudulent conveyances, and the determination and validity of liens and claims. Andrew handles complex real estate workouts, defends lenders in lender liability cases, and represents lenders, both as buyers and sellers, in assignments for the benefit of creditors and Uniform Commercial Code asset sales. Andrew has given seminars on mortgage foreclosure practices to lenders throughout the Chicago metropolitan area. In addition, he has counseled clients on a regular basis regarding lender liability issues and fair debt collection practices issues.
In the area of commercial litigation, Andrew has litigated, arbitrated, mediated, and settled cases involving actions for breach of contract or fiduciary duty, partnership and shareholder disputes, actions for breach of restrictive covenants, trade secrets, statutory construction, debt collection, trademark/copyright disputes, fraud, negligence and title insurance claims. Andrew has litigated complex commercial matters throughout the United States. He believes that in order to effectively represent a client, an attorney must know and understand the client’s business. That is the trait that makes Andrew an aggressive and efficient counselor and litigator. Andrew regularly counsels clients on business issues in an effort to find the optimal business/litigation solution for his clients.
