Ronald A. Damashek
Overview

Ron Damashek untangles real estate disputes for his clients. He analyzes coverage and addresses agent liability for title insurance companies, and represents their insureds on claims involving title defects, such as competing lien priorities, alleged unauthorized public record recordings, boundary disputes, and agent liability. Ron’s cases run the gamut from confirming free and clear home ownership to protecting mortgagees and reducing insurance exposure in the face of pervasive title and wire fraud.

Ron actively promotes and protects the interests of the state-wide title industry and its participants through amicus curiae briefs submitted on behalf of the Illinois Land Title Association, as well in cases brought by the Association itself, like its lawsuit to compel the Cook County Recorder of Deeds to record documents concerning the rights of heirs after the Recorder refused to do so.

As counsel to secured creditors, Ron regularly litigates and works out troubled loans, resolves disputes with borrowers, competing lien claimants and loan participants, and advises clients as to their contractual rights and obligations under loan documents, inter-creditor agreements, and purchase and assumption agreements. He has foreclosed hundreds of commercial mortgages on properties ranging from downtown office buildings to a suburban golf course, represented secured creditors in bankruptcy litigation, and worked with, and represented, court appointed receivers.

In addition, Ron regularly helps developers, property owners, and contractors navigate and resolve real estate disputes, including controversies involving municipalities, development partners, adjoining property owners, contractors, landlord-tenant relationships, and mechanic's lien claims. He represents condominium associations in resolving problems related to turnover, non-payment of assessments, owner property rights, election procedures and results, and construction defects, and regularly prepares and enforces condominium association contracts and guides boards in interpreting and complying with the Illinois Condominium Property Act and condominium declarations, by-laws, rules and regulations.

Chair of Stahl Cowen's litigation department, Ron assists clients facing a broad range of general commercial litigation issues, including breaches of contract and fiduciary duties, fraud, statutory violations, corporate and partnership disputes, and injunctions.

He is a former Chair of, and remains actively involved in, the American Bar Association – Tort Trial and Insurance Practice (ABA-TIPS) Title Insurance Litigation Committee, and regularly participates in Title Counsel meetings of the American Land Title Association (ALTA). Ron consistently is recognized as a peer designated member of Illinois Leading Lawyers and an Illinois Super Lawyer in Business Litigation.

Early in his career, Ron left his job to spend nine months travelling the world with his wife. That experience sparked a love of travel that continues to this day and has taken him to every continent save Antarctica. Body willing, Ron plays competitive soccer twice a week and is a frequent visitor to the New Orleans Jazz and Heritage Festival.
