Alpha Nature Resource Seeking To Unfairly Terminate Non-Union Retiree Benefits

Alpha Natural Resources, Inc., currently in Chapter 11 Bankruptcy, has announced its intention to terminate all non-union retiree healthcare and life insurance benefits. The Debtor, Alpha Natural Resources, is seeking to do this through an un-opposed and expedited process which would end-run the rights of retirees typically provided by the Bankruptcy Code. This would also affect retirees of Foundation Coal and Massey Energy Coal.

Currently, the Debtor is arguing to the Court that it has the right to terminate all of these welfare benefits, but the Company has only presented a small portion of the relevant facts to the Court. Moreover, there are currently no retirees and no Retiree Committee in place to dispute the legal and factual arguments being made by the Company. Salaried or Non-Union Retirees are urged to contact Stahl Cowen to have a Section 1114 Retiree Committee appointed without delay. Retirees seeking help will not incur any legal fees and no contingency fees are charged either. The Bankruptcy Code will require Alpha Natural Resources to pay for all such legal fees.
